Terms and Conditions

AgoForward is a service provided by the Agonian Alumnae Association, Inc. As a user on the AgoForward system, you are required to honor all the terms and conditions set forth here. User further understand that the Internet industry is new and AgoForward may from time to time need to amend the terms and conditions as the industry evolves. Existing users that are not able to honor all the terms set forth should contact AgoForward immediately for account cancellation. Continuing your use of AgoForward signifies your agreement to the new terms and conditions.

Description

AgoForward is an e-mail and homepage forwarding service provided by the Agonian Alumnae Association, Inc. of New Paltz College. It automatically forwards a user's electronic mail to their designated destination.

Fees & Charges

AgoForward is a free service to the Sisters of Alpha Kappa Phi - New Paltz, paid for by the Agonian Alumnae Association, Inc.

User's Responsibility

AgoForward may only be use for lawful purposes. User are expressly prohibited from using AgoForward for any activity that violates any local, state, national or other law. User also agrees to comply with all applicable local, state and national laws, regulations, or conventions. User are also expected to follow common Internet acceptable use practices as determined by AgoForward in its sole discretion.

Electronic Mail Usage:

Users must abide by the following guidelines:

Never send any chain letters via e-mail that contains an AgoForward address or domain name.
Never send any unsolicited e-mail that contains an AgoForward address or domain name.
Never use an AgoForward address in conjunction with mass mailings.
Never use an AgoForward address in conjunction with an auto responder system. Repeatedly sending a user e-mail with the intent to harass or harm their account is strictly forbidden.
This is generally called "Spamming" or "Mail Bombing" on the Internet.
Pyramid Schemes are illegal and are prohibited.
Get Rich Quick Schemes are prohibited.

Users must also abide by the following guidelines:

Commercial postings are not welcome in many newsgroups. Please checkout and use the proper news group for the posting.
Never "Cross Post" to news groups any messages or data that contain an AgoForward address or domain name.
Never post Chain-Letters, Pyramid-Schemes, or Get-Rich-Quick-Schemes that contain an AgoForward address or domain name.

While the freedom of speech is protected by the First Amendment of the Constitution, any activity, action or e-mail from any AgoForward user that triggers complaints, hate-mail, or blocks on our Domains at a particular site is prohibited.

Copyrights

You are responsible for determining the legal status of any intellectual property you use, duplicate and/or transmit/receive through AgoForward. You agree not to violate copyright laws by transferring copyrighted works through our system or by causing them to be transferred or stored without the permission of the copyright holder. You agree to accept all liability and responsibility for any violation of copyright laws.

Right to Privacy

You have a right to expect privacy for your information, especially for your electronic mail. It is our intention that the Electronic Communications Privacy Act apply to your account. We will not intentionally disclose the contents of private files without the user's permission or a court order. We cannot ensure total privacy of your E-mail due to the fact that occasionally E-mail is improperly addressed or routed and must be examined to determine the cause of the error. Do not send by E-mail any information that you would not wish to have scrutinized by the public. We are under an obligation to cooperate with law enforcement officials in the justified investigation of alleged unlawful activity.

Our Junk Mail Policy

AgoForward will not sell our subscriber list to any outside entities.

Account Termination

Use of AgoForward that violates any of the rules and regulations in this agreement is grounds for termination. AgoForward reserves the right to terminate any user in its sole discretion as deemed necessary to protect the rights of other AgoForward users.

Indemnify and Hold Harmless

User agrees to behave in an ethical manner regarding the use of service from AgoForward. User further agrees to indemnify and hold harmless AgoForward, the Agonian Alumnae Association, members, and agents for any consequences of their actions. User also agrees to abide by all state and federal laws governing the use of telecommunications and computers in the United States. Users understand that AgoForward exercises no control whatsoever over the content of the information passing through the Internet. AgoForward makes no warranties of any kind, whether expressed or implied, for the service it is providing. AgoForward also disclaims any warranty of merchant ability or fitness of a particular purpose. AgoForward will not be responsible for any damage you suffer. This includes loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions cause by its own negligence or your errors or omissions. Use of any information obtained via our service is at your own risk. AgoForward specifically denies any responsibility for the accuracy or quality of information obtained through its services.

Governing Law

Our on-line system can be reached by users from around the world. Any legal matters about AgoForward shall be governed by and interpreted in accordance with the laws of the State of New York, USA.
